    Homage or Rip-Off?

Just thought i'd get this off my chest and also see what you guys thought too.

A day or two after release of EVO, a couple of friends of mine told me about a track called 'City Nights' by a guy named ooO KENDO Ooo.
So i got the track and was gutted that he had near identically copied one of my old THD tracks called 'liverpool' that incidenltly was going to remake myself.
My problem is that i got no msg or indication from him that he would do this..
This has happened before to me with another track called 'Worktop Wonder' but the guy msg me that time and i didnt have a problem...felt honoured really, he changed it so the micro donkey could be used. And made a good job of it too.

I have msg ooO KENDO Ooo but got no reply.
So i leave it too the honest custom track community to give me an answer.....
    What do you think....

If there was no request for permission, and no credit given to you in his track... RIP-OFF.
    That's just not cool.

    ^^^ this.
Even if the person asked I'd be wary, but to just remake it without permission is just wrong..

I played your tracks on Trials HD, and they were pretty cool. So I`m on the +1 side that it`s not wright to copy without asking or telling. Shame on Kendo.

Was he at any time on your friends list so he could download the track? If so Then it's a ripoff.
If not then he couldn't study it that close. Perhaps he saw a video of it. Then he would only have some ideas to work from to build his own track. This would make it a homage.
Perhaps none of these happened, and he just made something out of the blue, which would not fit in either category. Perhaps it's the same source where you got your first inspiration.
You should still remake your track the way you want it.

    Homage or Rip-Off?

People should include the original creator's GT in remade tracks.

Here's the track he's referring to:

    And here's his original:

It's kinda like one of the comments said, imitation is a form of flattery.

I'd take it as a homage.

    ...a homage rip-off.

    **EDIT** fixed the youtube links

Blatant rip off. There's no way around it. If he hadn't copied the background and the sun/moon and the camera angle then MAYBE but as it is it's a total rip off. We could all go and rate it down for you
