if a game company says there's a NDA on un released game play then there is. that said if you don't want to sign the NDA then you just have to wait till they announce a non NDA beta easy that said beta been bumped to 2016 ,

The Xbox One Alpha is apparently an earlier build of the game, and it is being used to test several things; like how the servers handle the stress, and how the gameplay mechanics work (balancing weapons and loot drops etc.) rather than focusing on "how pretty the game looks" or similar.

We haven't heard any real information about what the Beta will be yet, but I think it will be a fairly big part of the map, but just with no missions relating to the final story in it.
I think it is likely that we will be allowed to show the Beta, as they will use it as a bit of advertising just before the game's launch on March 8th, but I think that depends on how well this Alpha goes.
The Beta is usually the final build of the game, and is simply used to iron out any last bugs and balancing issues. With thousands of people playing at once, they will be able to see quite how things work in terms of battles, and statistics.

i really think this just a small stress test to see what servers will be like for Closed beta , and this build is probably a older version compared to there current build ,

one part of solution could be found here :

I regret that the initial poster havent found this.

This exclusive Xbox One alpha (prepay beta) testing phase in December will be the first time the public gets to play a version of The Division that includes more than the Dark Zone PvP enabled areas. This means the moment you and other players sign into the game, you’ll be giving us valuable insight into how our infrastructure performs under pressure that we can’t replicate internally or at a tradeshow. This process allows us to monitor and gather additional feedback on other aspects of The Division, as well. However, due to the early stage of this alpha (prepay beta), we ask that all participants do not share images, video, or descriptions of the game’s content outside of the official Division alpha forum. Players will be prompted to accept a non-disclosure agreement before playing the alpha (prepay beta).
remember that we pay to play during beta. It's a garanted condition buying. Ah ! someone say me that NDA is writen in little caracther after the signing line.

No one is paying to play alpha or beta, it's simply an additional thing when you pre-order (there's no mark-up for alpha/beta access, all you're doing is pre-ordering a game). Additionally, players who signed up to the waiting list can also participate. So the argument that you've paid to be in the alpha/beta and thus there shouldn't be an NDA is invalid. Even if you did pay, you still have to abide by the rules and limitations set by the brand

Access to the forum should be there starting on the 9th. Mind you it could be delayed a bit as we have to grant access manually

    - Are you able to recreate the bug/glitch
eg: Repeatable. - Tried from (North / South / East / West) and only works from (example) positions.
    Thanks for the help.

You're paying for the final product, not to be able to play the product early. The Alpha is still a lottery, only a certain amount of people will get in. It's not a guarantee, even for those who preorder the game. This is an important time in the development process for players to give constructive criticism and feedback to make the game better. The Alpha trial is not indicative of the final product and should never be viewed as such. It should not be considered a privilege or a right to participate.
